DUI LawyerDriving Under The Influence (DUI)
Arrested for DUI (drunk driving)?
You only have 10 days until you lose your license!
DUI Attorney Kory Mathewson may be able to get your charges reduced or dismissed, and save your California drivers license.
Most people arrested for DUI in Riverside County get charged with two offenses: Vehicle Code 23152(a) driving under the influence, and Vehicle Code 23152(b) driving with excessive BAC.
Both of these are considered DUI offenses. The law has been expanded to further specify when an individual is under the influence of drugs specifically including prescription medications, Vehicle Code 23152(e), or under the influence of alcohol and drugs combined, Vehicle Code 23152(f).
Generally drunk driving suspects get released from jail within a few hours of their arrest. In a felony DUI or felony DUI with injury or vehicular manslaughter case, a person might be held in custody until their bail is posted. Most inmates are usually held at the Robert Presley Detention Center or the Southwest Detention Center in Murrieta. Juveniles may be held at the Riverside Juvenile Hall.
When you hire us as your criminal defense lawyer for DUI we can usually appear on your behalf at court and deal directly with the DMV to help save your license.
The court and DMV are two separate cases against you that we need to fight. Our goals for you are:
- Get the court charges to be reduced or dismissed, while avoiding jail time
- Prevent the DMV from suspending your drivers license suspension
Riverside CA DUI Penalties
The penalties for a DUI conviction in Riverside range from:
- Jail time, work release or electronic monitoring
- DUI School
- License Suspension
Riverside courts may impose jail time, even on a first offense. The sentencing is usually 6 to 10 days on a first offense, 30 days on a second offense, and at least 120 days, often more, of jail for third time DUI. In a lot of cases DUI offenders can serve their time in a work release capacity rather than actually staying in a jail facility. Riverside courts have also been amenable to not imposing any jail time for first DUI offenses if the case resolves very early. This can be a good thing or a bad thing depending on the case you have.
A good Riverside DUI criminal defense lawyer should review the police reports with you and provide you a detailed plan of defense and whether a case should settle or proceed to trial.
