Most people arrested for DUI in Riverside County get charged with two offenses: Vehicle Code 23152(a) driving under the influence, and Vehicle Code 23152(b) driving with excessive BAC.

Generally drunk driving suspects get released from jail within a few hours of their arrest. In a felony DUI or felony DUI with injury or vehicular manslaughter case, a person might be held in custody until their bail is posted. Most inmates are usually held at the Robert Presley Detention Center or the Southwest Detention Center in Murrieta. Juveniles may be held at the Riverside Juvenile Hall.

Riverside courts may impose jail time, even on a first offense. The sentencing is usually 6 to 10 days on a first offense, 30 days on a second offense, and at least 120 days, often more, of jail for third time DUI. In a lot of cases DUI offenders can serve their time in a work release capacity rather than actually staying in a jail facility.  Riverside courts have also been amenable to not imposing any jail time for first DUI offenses if the case resolves very early.  This can be a good thing or a bad thing depending on the case you have.
